Also, the fact that you are in another state won’t necessarily protect you. If the case is in a federal court, you can be subpoenaed anywhere in the country. If the case is in state court in another state, the plaintiffs’ lawyer will need to have a court in your state issue the subpoena, but that’s just an extra step for the lawyer that typically involves little more than filling out some forms.

The hospital’s legal team may offer to represent you on the hospital’s dime (or perhaps the hospital’s liability insurer’s), because then they can prep you and find out ahead of time what you will say at your deposition, and your conversations with them will be protected from disclosure by attorney-client privilege. You may want to consult with another lawyer before you agree. That said, if the hospital’s lawyers agree to represent you, you are their client as much as the hospital is, and the rules of professional conduct that govern lawyers forbid them—on penalty of sanctions up to and including disbarment—from prioritizing the interests of one client at the expense of another client. If a situation arose where it was in the hospital’s best interest to throw you under the bus, the hospital’s lawyers likely would be obligated to withdraw from the case entirely due to the conflict of interest.

Same thing happened to me, I was in another state and the hospital flew their lawyer in to do a recorded deposition at a law firm that was nearer. I don't remember how or why the hosting firm was involved, if not just to provide a closed space. Anyway, before this happened I was sent records and looked them over, I was doing the deposition b/c I saw the patient on a consult for an attending who actually was named in the suit. I also thought I might be able to decline because at that point I was out of residency at least 3 years, but I had to do it after all. The lawyer that I worked with went over the process beforehand and it went fine. I haven't heard a peep since.

I was deposed as a resident for a case that happened when I was a PGY2 and I was not personally named in the case but I had written a progress note on the patient post-op. At least for me it happened when I was a PGY4 so still in the same city. The lawyers for the hospital where it happened reached out and I communicated with them exclusively. (If I had been named in the suit, I probably would have also gotten my own lawyer). They will provide you with a big binder of the notes from the case to refresh your memory. Like another poster said, they may not deem your testimony necessary when you tell them that they have to come to you (or pay for your travel) to get it. But for the love of God, don't ignore them. And only talk to lawyers representing the side of your residency program.

Don't ignore it. A co-res of mine who had moved to the west coast after residency was also emailed seeking her deposition, and they emailed her non-working old residency email. After MONTHS of them emailing this broken email multiple times they reached out to the chair of our department who tracked her down via text. They will find you, and if you ignore it on purpose, they'll be mad when they do.

Except that’s a terrible idea because OP was affiliated with the hospital and must be connected somehow to the events that gave rise to the lawsuit m, or a/he wouldn’t be on the plaintiff’s radar. OP may have an incentive to lie to protect OP’s reputation, or that of the hospital and/or OP’s former coworkers, which the plaintiff’s lawyer would undoubtedly point out at every opportunity in order to undermine OP’s credibility.
